Exclusive spousal trust

Tax term referring to a trust, either testamentary or inter vivo, created in favor of the spouse. In this type of trust, only the spouse has the right to the income for their lifetime, and no other person besides the spouse can use or otherwise receive the income or capital of the trust during the spouse's lifetime. A person can benefit from a tax rollover when transferring assets to such a trust as if the transfer were made directly to their spouse.
